1. Acceptance of Terms

Welcome to Aleph ("the App"), a Torah learning application for children. These Terms of Service ("Terms") constitute a legally binding agreement between you and Aleph ("we," "us," or "our") governing your access to and use of the App, including all content, features, and services offered through the App.

By creating an account, downloading, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are a parent or legal guardian creating an account for a child under 13, you agree to these Terms on behalf of your child and accept responsibility for their use of the App.

If you do not agree to these Terms, you must not use the App.

2. Eligibility

The App is designed for children learning Torah. If you are under 13 years of age, you may only use the App with the consent and supervision of a parent or legal guardian. By allowing your child to use the App, you represent that you are the child's parent or legal guardian and that you consent to the child's use of the App in accordance with these Terms.

If you are between 13 and 18 years of age, you may use the App with the consent of your parent or legal guardian, who agrees to be bound by these Terms.

3. Account Registration

To use the App, you must create an account using one of our supported authentication methods: Apple Sign In, Google Sign In, or email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update such information as necessary. We reserve the right to suspend or terminate accounts that contain false or misleading information.

You may not create more than one account per person, share your account credentials with others, or use another person's account without their permission.

4. Description of Service

Aleph provides an interactive Torah learning experience for children, including:

  • Interactive Lessons: Guided Torah story lessons with quizzes and activities covering topics from Bereishit (Genesis), Shemot (Exodus), and more.
  • Gamification Features: Experience points (XP), gems (virtual currency), hearts (lives), daily streaks, quests, and achievements to encourage consistent learning.
  • Mascot Customization: Virtual character customization with hats, outfits, glasses, and other cosmetic items purchasable with in-app gems.
  • Chavruta AI (Premium): An AI-powered Torah study companion ("Rabbi Robot") that answers questions about Torah stories in an age-appropriate manner.
  • Daily Tools: A Mizrach compass for finding the direction of Jerusalem, and other learning aids.

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice, and without liability to you.

5. Subscriptions and Payments

5.1 Aleph Plus

The App offers a premium subscription called "Aleph Plus" that provides additional features including unlimited hearts, unlimited AI chat sessions, double gem earnings, and exclusive cosmetic items.

5.2 Subscription Plans

Aleph Plus is available as a monthly or yearly subscription. Current pricing is displayed in the App at the time of purchase. All prices are in the currency of your App Store account.

5.3 Free Trials

We may offer free trial periods for Aleph Plus. If you begin a free trial and do not cancel before the trial period ends, you will be automatically charged the subscription fee for the plan you selected. You will only be eligible for one free trial per Apple ID.

5.4 Billing and Auto-Renewal

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.

5.5 Managing and Cancelling Subscriptions

You may manage or cancel your subscription at any time through your device's subscription settings (Settings > Apple ID > Subscriptions on iOS). Cancellation takes effect at the end of the current billing period. You will continue to have access to premium features until the end of your paid period. No refunds or credits will be issued for partial billing periods.

5.6 Price Changes

We may change subscription prices from time to time. Any price change will take effect at the start of the next subscription period following the date of the price change. If you do not agree with the price change, you may cancel your subscription before it renews.

5.7 Refunds

All purchases are processed through Apple's App Store. Refund requests must be submitted directly to Apple in accordance with their refund policies. We do not process refunds directly.

6. Virtual Currency and Items

The App features virtual currencies and items, including "gems" and cosmetic items for mascot customization. These virtual items have no real-world monetary value and cannot be exchanged for real currency, goods, or services. Virtual items are non-transferable and non-refundable.

We reserve the right to modify, manage, regulate, control, or eliminate virtual items at any time, with or without notice. We shall have no liability to you for exercising these rights.

7. AI Chat Feature (Chavruta)

The Chavruta AI feature uses artificial intelligence to provide Torah learning assistance. You acknowledge and agree that:

  • AI responses are generated by machine learning models and may not always be accurate, complete, or appropriate. The AI is designed to be educational and age-appropriate, but it is not a substitute for qualified religious instruction.
  • AI-generated content does not represent the views or opinions of Aleph, and we do not guarantee the accuracy or religious authority of any AI response.
  • Your chat messages are processed by third-party AI services (OpenAI) to generate responses. See our Privacy Policy for details on how your data is handled.
  • Usage limits apply: a maximum of 100 messages per day and 5 messages per minute.
  • You should not share personal, sensitive, or identifying information in chat messages.

8. Acceptable Use

You agree to use the App only for its intended purpose of Torah learning and not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the App, other accounts, computer systems, or networks connected to the App.
  • Interfere with or disrupt the App or servers or networks connected to the App.
  • Use any automated means (bots, scrapers, etc.) to access or interact with the App.
  • Reverse engineer, decompile, or disassemble any part of the App.
  • Attempt to manipulate game mechanics, cheat, exploit bugs, or otherwise gain an unfair advantage.
  • Submit harmful, abusive, threatening, or inappropriate content through the AI chat feature.
  • Use the App to harass, abuse, or harm another person.

We reserve the right to suspend or terminate your account for violations of these Terms.

9. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, images, audio, video, illustrations, animations, lesson content, and software, is the property of Aleph or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms. This license does not include the right to:

  • Copy, modify, or distribute the App or its content.
  • Use the App's content for commercial purposes.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.

10. Account Deletion

You may delete your account at any time through the App's Settings page. Account deletion is permanent and irreversible. Upon deletion:

  • All your personal data, learning progress, inventory, chat history, and account information will be permanently deleted from our servers.
  • Any active subscription will not be automatically cancelled. You must cancel your subscription separately through your device's subscription settings before deleting your account to avoid continued charges.
  • Virtual items, gems, XP, and all other account data cannot be recovered after deletion.

11. Third-Party Services

The App integrates with third-party services to provide its functionality. These include:

  • Apple App Store: For app distribution and subscription payment processing.
  • Supabase: For authentication, data storage, and backend services.
  • OpenAI: For AI-powered chat functionality.
  • RevenueCat: For subscription management.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content, including AI-generated responses.

The educational content in the App is intended for general learning purposes and should not be relied upon as authoritative religious instruction. We encourage users to consult qualified educators and religious authorities for religious guidance.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALEPH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use or inability to use the App.
  • Any content obtained from the App, including AI-generated responses.
  • Unauthorized access to or alteration of your data or transmissions.
  • Any third-party conduct on the App.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Aleph and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. For material changes, we may also provide additional notice through the App.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aleph regarding the use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
